01-FY2024 08/28/2023 A complaint was filed regarding a business owner practicing medical nutrition therapy without a license. This complaint was previously labeled as complaint # 03-FY-2023.Complaint was investigated. Business owner was contacted via email and certified mail. Certified letter and email send first week of September. Owner's attorney responded (10/3/2023) through written communication with BOLD and board attorney. Owner/attorney report no practice of MNT in the business. Communication with owner/attorney; no MNT practiced; education on MNT and Licensure provided by board attorney. Case closed 12/04/2023
02-FY2024 08/28/2023 Licensee practiced without a license from September 2022 to June 2023. This complaint was previously labeled as complaint # 04-FY-2023.Complaint was investigated. Board attorney composed letter and BOLD sent letter via email and certified mail (8/30/2023), response received via email that communication was received (9/5/2023). Licensee responded on 10/21/2023 agreeing to conditions in the letter and ask board attorney to prepare a proposed Consent Agreement and Order. Signed Consent Agreement and Order received via email (11/6/2023) and US mail ( 11/20/23). Letter was signed by BOLD chair on (12/4/23) and sent to board attorney and licensee. Consent Agreement and Order signed 12/04/2023

01-FY2023 02/07/2023 A complaint was filed regarding the billing of services for an appointment with a licensed dietitian. The licensed dietitian was contacted and provided her account of the issue and described the billing process.(Complete) A fraudulent billing practice was not identified
02-FY2023 02/15/2023 A verbal complaint was made at a virtual meeting from PERD of a LD not being notified of pending license expiration and provided time for renewal. Several LDs provided a copy of the one of the emails sent from the WVBOLD email contact list notifying them to renew (04/01/2022 and 05/04/2022). Complaint not substantiated.

02-FY2021 08/30/2021 ADVANCED NUTRITION SOLUTION PROVIDING MNT W/O A LICENSE. BUSINESS OWNER SPOKE TO THE BOARD ABOUT HIS SERVICES. 11/29/21 - HE STATED HE HAS HIRED A REGISTERED/LICENSED DIETITIAN.
